HR Compliance Checklist for Behavioral Health & Human Services

State-by-state requirements for North Carolina, South Carolina, and Georgia. Know what you owe before the audit finds it.

What's Inside the Checklist

Licensing & Credentialing

State-specific requirements for behavioral health and human services staff. Understand which credentials are mandatory, which are preferred, and how they differ across NC, SC, and GA.

Employment Law Compliance

FMLA, ADA, background check rules, and workforce regulations. Know your obligations in each state and avoid costly violations of federal and state employment law.

Documentation & Audit Readiness

Record retention requirements, I-9 compliance, incident reporting, and audit documentation standards. Build a paper trail that holds up under scrutiny.

The 2026 HR Compliance Checklist for Behavioral Health and Human Services

Compliance risk in this sector is not theoretical and it is not evenly distributed. It concentrates where turnover is highest, because every departure creates an incomplete file, a missed training, a lapsed verification. With sector turnover running 40 to 70 percent and 88 percent of providers reporting staffing shortages, the average behavioral health organization is generating compliance gaps faster than it closes them. That is why this checklist and the turnover cost calculator are two views of the same problem: workforce instability is compliance exposure with a payroll attached.

Work through it live. Check what you can prove with documentation today, not what you believe is probably handled. Your score updates as you go. The downloadable version adds full state-by-state addenda.

Federal employment law

The federal layer applies to every organization regardless of state. These are the items EEOC investigators and Department of Labor auditors check first.

HIPAA and privacy

For behavioral health and SUD providers, privacy compliance is workforce compliance. Most breaches trace to an employee action.

Accreditation and payer requirements

CARF, Joint Commission, and Medicaid all audit HR files. Their standards overlap but do not match, and the strictest one governs.

Clinical workforce files

The files that protect your license to operate. These are the items state surveyors and plaintiff attorneys request by name.

Training cadence

Training that is not documented did not happen, as far as any auditor is concerned.

The state layer

Everything above sits under your state stack: labor law, licensure rules, Medicaid manual requirements, and background check statutes that differ at every border.

Anything unchecked is exposure with a date on it.

HR compliance questions we hear every week

What should an HR compliance checklist include for behavioral health organizations?

Six layers: federal employment law (FLSA, FMLA, ADA, I-9, OSHA), HIPAA and 42 CFR Part 2 privacy requirements, accreditor and payer standards (CARF, Joint Commission, Medicaid), clinical workforce files (exclusion screening, credentialing, supervision documentation), a documented training cadence, and state-specific requirements for every state where you employ anyone.

How often should HR compliance files be audited?

Exclusion screening monthly, licensure verification at every renewal, a personnel file sample quarterly, and a full compliance file audit annually or before any scheduled accreditation survey. The cadence matters less than the documentation: an audit without a written result did not happen.

What does CARF require from HR?

Documented job descriptions, verified credentials and competencies for every position, orientation and ongoing training records, performance evaluations on a defined schedule, and personnel policies applied consistently. Surveyors verify by pulling individual files, so one incomplete file is a finding.

What is 42 CFR Part 2 and who needs training on it?

The federal confidentiality rule for substance use disorder treatment records. It is stricter than HIPAA and applies to any staff member who touches SUD records, including administrative and billing staff. Generic HIPAA training does not satisfy it.
